TERMS OF USE – PERSONAL/S4H TERMS

Thank you so much for purchasing/downloading my graphics!
By downloading files from any of my stores, or from my blog, you acknowledge receipt of a license to use the downloaded files for Personal and Limited Scrap4Hire Use ONLY, but not the rights to the designs themselves. You may NOT share or redistribute my products in any way, shape or form. The graphic files contained in my downloads are the product of Tracy Anderson. I reserve the right to update my Terms of Use (TOU) at any time. While notification of changes to my TOU will be made, when possible, notification is not always guaranteed. By purchasing this product, you agree that you will remain aware of my current TOU found here on my website and agree to be bound to the terms AND future changes to those terms. It is your responsibility, as the end user, to be aware of changes to my TOU and to follow such changes accordingly.

Examples of acceptable uses under the Personal Use License:

Use my products for your own personal use – for scrapbook pages and albums, cards and gifts.
Alter the files any way you want-resize them, recolor them, blend them together, you name it.
Submit layouts and other creations that you make with my products to online galleries, magazines etc. Credit for my designs is always appreciated, but not required, unless you are being “published” in either a print or online publication. In that case, please do ensure that I am credited for my designs.
Use my designs to decorate your own personal, non-commercial blog or website, as long as you are the person doing the work and no one is being paid to decorate your blog or website for you. The following stipulations must be observed:
- When my designs are used on a personal blog/website, they must be right-click protected and credit must be given in the sidebar or other conspicuous area of the site, with a link back to my site at https://www.trixiescraps.com.
- If you do not know how to protect the graphics from right-clicking, or you are unwilling to provide credit for the graphics on your blog/website, please do not use my designs in this way.
- If your blog or website is monetized in any way (either by the inclusion of paid affiliate banners, pay per click advertising, or the promotion of products or services for sale), then you may NOT use my products to decorate your blog or website.

Examples of acceptable uses under the Scrap For Hire (S4H) License:

You may use my designs in your home based business as long as the finished product is a provided to ONE end-customer as either a flattened JPG file or in printed form.
My original files may not be redistributed in any way.
You must be selling a finished product complete with photos, to the end customer. This means each and every product you sell will be a unique, finished design specific to each individual customer.

Examples of prohibited uses under the Personal and Scrap For Hire (S4H) Licenses:

You may not use my designs for any business that involves birthday invites, party planning or announcement printables on any sites such as Etsy, Ebay or similar. I have special terms for products sold on Teachers Pay Teachers – please refer to them here.
You may not make any “quick pages” that you will redistribute or resell for other people to complete with their own photos.
You may not use my designs in any online graphic design business, including the design of other websites or blogs.
You may not use my designs to decorate any online website, social media site or blog for a business, company or other commercial concern. If your blog or website is in any way commercial in nature, you may not use my graphics to decorate your site. This means if you make/sell/market/give away a product or service, you may not use my graphics to decorate your website.
You may not use my designs in any business that sells design services for online websites, social media sites or blogs for others.
You may not use my designs to create freebies that you offer for download on your blog, website or social media site.
You may not claim the images as your own work, whether it is altered or in it’s original form.
You may not distribute, redistribute, repackage, re-sell or in any other way share my designs.
You may not use my designs for obscene, defamatory, or immoral works or for any other purpose which is prohibited by law.
You may not use my designs in “tagger” designs featuring scantily clad, half-dressed, or “revealing” figures. If you are in doubt that I would approve of the image, please submit a support ticket and ask for clarification OR do not use my designs at all.
Any other use that is not specifically addressed by this Terms of Use document is strictly prohibited.

Feel free to submit a support ticket if you need clarification of any of my terms before using my designs in a way that might violate these terms.

Limited Liability:

The content is provided “as is” without warranty of any kind. Trixie Scraps Designs and/or Tracy Anderson shall not be liable for any incidental, indirect, or consequential damages of any kind, or any damages in connection with the use of the content.

TERMS OF USE – LIMITED COMMERCIAL USE TERMS

From time to time, I release a product that is marked “ok for commercial use.” These products are usually layered 12×12 page templates and the commercial use license applies as follows.

Examples of acceptable uses for products marked “OK for Commercial Use”

You may use these files for personal use and S4H (please observe the personal/S4H terms above).
You may use my template packs, when marked as “OK for CU” to create your own flattened quick pages (using your own designs) for sale to the personal use market or scrap for hire market. No credit is required when using my Commercial Use-approved template packs in this way, however, should you like to give me credit for the tools I’ve provided you, it is always appreciated.
You may alter my CU tools for your own purpose. This includes adding to or removing from the template files, changing the size/shape/layout of any of the page items, etc. Feel free to use the template files and make them your own, in the creation of your quick pages.

Examples of prohibited uses for products marked “OK for Commercial Use”

You may not recolor or otherwise alter my commercial use products and then sell them as your own commercial use product.
You may not redistribute my CU products as your own CU product in any way, shape or form.
You may not use my commercial use products to create freebies to give away on your blog.
You may not claim the products as your own work, whether it is altered or in the original form.
You may not distribute, redistribute, repackage, re-sell or in any other way share the designs.
You may not use these files for obscene, defamatory, or immoral works or for any other purpose which is prohibited by law.
